Welcome to NoticdGolf. These Terms of Service ("Terms") govern your access to and use of the NoticdGolf mobile application, website (noticdgolf.com, noticdgolf.golf), and related services (collectively, the "Platform"), operated by [LEGAL ENTITY NAME] ("we," "us," or "our").
By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Eligibility
You must be at least 13 years of age to use the Platform. If you are between 13 and 17 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. Users under 18 must have a guardian linked to their account before receiving recruiting contact from coaches.
2. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Each individual may maintain only one account. You must notify us immediately of any unauthorized use of your account.
3. User Roles
The Platform supports distinct user roles: Athletes, Coaches, and Guardians. Each role has specific capabilities and restrictions:
- Athletes may create profiles, upload video content, and manage recruiting communications.
- Coaches must complete identity verification before initiating contact with athletes. Verification may include domain-based email verification or manual document review.
- Guardians may link to athlete accounts and must approve recruiting contact for athletes under 18.
4. User Content
You retain ownership of all content you submit to the Platform, including videos, posts, profile information, and messages ("User Content"). By submitting User Content, you grant NoticdGolf a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute your User Content solely for the purpose of operating and improving the Platform.
You represent that you have the right to submit all User Content and that it does not infringe on any third party's intellectual property or privacy rights.
5. Recruiting Communications
All initial contact between coaches and athletes is conducted through the Platform's relay messaging system. Coach messages are delivered without revealing the athlete's personal email address. An athlete's email address is shared with a coach only when the athlete explicitly grants consent through the Platform's email release feature.
Coaches are subject to rate limits on contact requests (currently 20 per day) to prevent spam and protect athletes.
6. Content Moderation
All uploaded videos and content are subject to review. We reserve the right to remove, restrict, or flag content that violates these Terms or our community standards. Our moderation process includes:
- Uploaded videos enter a review queue before becoming publicly visible.
- Users may report content for review by our moderation team.
- Violations result in strikes. Three strikes within 30 days may result in temporary suspension. Five strikes within 90 days may result in permanent account revocation.
7. Prohibited Conduct
You agree not to:
- Impersonate any person or misrepresent your identity, affiliation, or role.
- Harass, threaten, bully, or intimidate any user.
- Submit misleading, false, or deceptive content, including fabricated athletic credentials.
- Scrape, crawl, or use automated means to access or collect data from the Platform.
- Use the Platform for any purpose unrelated to college athletic recruiting.
- Circumvent or attempt to circumvent verification, moderation, or safety features.
- Upload content that is violent, sexually explicit, or otherwise inappropriate.
8. Intellectual Property
The Platform, including its design, logos, features, and underlying code, is the property of [LEGAL ENTITY NAME] and is protected by intellectual property laws. "NoticdGolf" and associated branding are trademarks of [LEGAL ENTITY NAME]. You may not use our trademarks without prior written consent.
9. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT USE OF THE PLATFORM WILL RESULT IN RECRUITING OFFERS, SCHOLARSHIPS, OR ANY PARTICULAR OUTCOME. WE DO NOT VERIFY THE ACCURACY OF ATHLETE-SUBMITTED ATHLETIC STATISTICS OR ACADEMIC RECORDS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, [LEGAL ENTITY NAME] SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
